ESTATE OF DONNA SAUNDERS, Deceased (17-1182);ESTATE OF DONNA SAUNDERS, Deceased (17-1182/A) — On the September 4, 2018 return date of this motion, all the parties to the petition and cross-petition for the issuance of letters of administration appeared and consented to the relief requested. The motion, made by petitioner, sought a direction that cross-petitioner for letters of administration qualify as administrator by a date certain or be deemed to have renounced his appointment (SCPA 1006). On the record, cross-petitioner consented to the issuance of this decision and decree deeming him to have renounced his appointment, which had been made by decree of this court dated January 25, 2018, directing letters to issue upon his filing a bond in the sum of $500,000. The bond was never posted and letters had not issued to cross-petitioner.Accordingly, the court granted the motion, restored to the calendar movant-petitioner’s application for the appointment of the Public Administrator, dispensed with service of process on Charles Saunders, and granted the petition, directing that Letters of Administration issue to the Public Administrator.Decree signed. Clerk to notify.Dated: September 19, 2018
