(15-0031/C/D) — This is a proceeding to revoke the letters of administration issued to the Public Administrator in the estate of William Henry Tyler, Jr. Incident to the proceeding, petitioner sought a kinship hearing to determine his status as decedent’s sole distributee. Based upon the proof submitted at two kinship hearings before a court attorney-referee, the court finds that decedent was survived by one son as his sole distributee.The court is satisfied that diligent and exhaustive efforts have been made, without success, to determine whether other distributees exist, that more than three years have passed since decedent’s death, and that no claim to a distributive share in the estate has been made by any person other than the above-mentioned distributee. It is therefore determined that no distributees exist other than the one established in the record before the court (SCPA §2225).Accordingly, letters of administration issued to the Public Administrator shall be revoked. Letters d.b.n. shall issue to Everett Hughes, decedent’s son and sole distributee. Settle decree.Dated: March 20, 2018Surrogate MellaESTATE OF EDWARD HUTTON, Deceased. (15-2879/A/B) — In this proceeding by a judgment creditor to compel the administrator of the estate of Edward Hutton to pay her judgment, the court entered an order on November 22, 2017, directing the administrator to post a bond in the amount of $354,000. At the call of the calendar on March 16, 2018, and on the consent of the creditor, the court vacated the order, it appearing that the estate is insolvent and the administrator is unable to obtain a bond. In lieu of a bond, the court directed that the administrator’s letters be restricted to prohibit distribution from the estate until further order of the court (SCPA 702[2], 702[10]).The administrator’s petition for an order reducing the bond is denied as moot. Her letters of administration shall be modified to add the restriction as provided herein.This decision constitutes the order of the court.Dated: March 19, 2018ESTATE OF ALPHONSO D. BROOKS, Deceased. Brooks, to discuss the proceeding commenced by Nancy Thomas, as Administrator D.B.N., for the return of allegedly improperly distributed assets.As to the relief sought concerning the turnover of funds paid to Tatia Barnes, Esq., former counsel to the prior administrator, Geneya Brooks, Ms. Barnes is directed to file a verified answer by April 6, 2018, and Ms. Thomas shall file a reply by April 20, 2018.This decision constitutes the order of the court.Clerk to notify counsel for all parties who have appeared in this proceeding.Dated: March 21, 2018Estate of ALPHONSO D. BROOKS, Deceased. (13-51/K) — After a conference with the court, Geneya Brooks, former administrator of the estate of Alphonso D.
