DECISION/ORDER

*1  Militana Place LLC, the petitioner in this proceeding (“Petitioner”), commenced this summary proceeding against Agnes Abude, the respondent in this proceeding (“Respondent”), seeking a money judgment and possession of 44 West 89th Street, Apt. 3A, New York, New York (“the subject premises”) on the ground of nonpayment of rent. Respondent interposed an answer raising a defense, inter alia, that Petitioner sought a judgment based upon an illegal rent. The Court held a trial of this matter on October 20, 2017. Neither party disputed that the subject premises is subject to the Rent Stabilization Law, nor that Respondent has been in occupancy of the subject premises since 1993.Respondent and Petitioner’s predecessor-in-interest1 entered into a stipulation settling a prior nonpayment proceeding captioned at Elder Care Properties v. Abude, Index # L/T 61182/2012, dated December 4, 2012 (“the Stipulation”). Petitioner’s predecessor-in-interest appeared by counsel in the Stipulation and Respondent appeared pro se. The Stipulation
