ESTATE OF CONNIE ALINI, Deceased (13/1273/A) — Objections to the instrument offered for probate of the above named decedent have been filed in this Court. Within thirty (30) days of the date hereof, proponent shall submit to the Court a Citation directed to all persons, if any, named or referred to in the propounded instrument who have not appeared in the proceeding, and whose interests could be adversely affected by the outcome of the proceeding. The Citation shall recite that objections have been filed and that such objections may be determined at a trial, hearing, or conference upon the return date, or such other date fixed by the Court, and the consequences for failing to appear as provided in SCPA 1411(6).

The Citation should be completed and submitted to the Court for fixing the return date. The Citation then must be served in accordance with the requirements of SCPA 307 and SCPA 308, except that service may be made by mail as therein provided upon any person, whether or not a resident of this State. The proponent shall also mail a copy of the Citation to counsel for the objectant, and notify all who have appeared of the return date of Citation. Proof of service of the Citation shall be made and filed in the Court at least two days prior to the return date of the Citation, unless a waiver of the service of the Citation has been filed. Should Citation not be required in the estate herein, the proponent shall nevertheless submit to the Court an affirmation so indicating, and request that the matter be restored to the Calendar for further disposition.
