CAHILL, JR., as Ancillary Administrator CTA and ALICIA HEINIGER as Ancillary Executor of the Estate of PATRICK HEINIGER, Deceased, and HODET CORP., Respondents, File No.: 2013-2228/C—At the call of motion calendar on October 28, 2014, the court granted this uncontested motion by petitioner Hana Nina Stevens for the issuance of letters of request in aid of discovery in Switzerland from Odette Heiniger and Sebastien Heiniger, the mother and son, respectively, of decedent Patrick Heiniger (CPLR $ 3108 [referred to as letters rogatory]; see Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters of 18 March 1970,23 UST 2555, TIAS 7444 [ratified by The United States on Oct. 7, 1972]).

The letters of request (letters rogatory) are issued in this proceeding as agreed to in and attached to the October 10, 2014 stipulation of all parties, filed with the court, and are directed to the Tribunal Civil-Tribunal De Premiere Instance, Geneva, Switzerland, requesting that it, in furtherance of justice and by the proper and usual procedures of that court, cause process to be issued that will be served upon non-party witnesses Odette Heiniger and Sebastien Heiniger in the above-captioned proceeding, and to cause the Central Authority in Switzerland to confirm process was served. The letters of request indicate that this court shall be ready and willing to do the same for that foreign court in a similar cause when required.
