GUARDIANSHIP OF DWAINE C., a MENTALLY RETARDED PERSON (91/A 87G) — The standby guardian of the person of the respondent, Deborah L. W., the respondent’s sister, seeks confirmation as the successor guardian of the person of the respondent pursuant to SCPA 1757 and the appointment of the respondent’s niece, Jamilah C., as the new standby guardian of the person of the respondent. By decree entered October 18, 1991, the respondent’s mother was appointed guardian of the person of the respondent, and by order dated December 21, 2000, the petitioner was appointed standby guardian of the person of Dwaine. The respondent’s mother died on February 12, 2014. Mental Hygiene Legal Service, First Judicial Department (MHLS), filed a report indicating it has no objection to the appointment of the petitioner as successor guardian of the person of the respondent.

As it appears to be in the best interests of the respondent that the petitioner be appointed the successor guardian of his person, the application is granted. Successor letters of guardianship of the person of the respondent shall issue to Deborah L. W., the respondent’s sister. Jamilah C., the respondent’s niece, is appointed standby guardian of the person of the respondent to serve when the primary guardian is no longer able to do so and shall assume the duties of office subject to qualification and confirmation pursuant to SCPA 1757. The letters of guardianship that issued to the respondent’s deceased mother shall be revoked in the decree to be entered hereon.
