ESTATE OF BERNARD L. PACELLA, Sr., Deceased (155P2007/H) — In this compulsory accounting proceeding commenced by a son of the decedent, objections were filed by the respondent, the preliminary executor, who is another son of the decedent. Preliminary letters testamentary issued to the respondent on March 1, 2007 and were revoked on August 15, 2012. The respondent, conceding that “accountings would normally be granted as a matter of course,” objects to the proceeding asserting he has no records on which to base an accounting as the same were turned over to the petitioner. To the extent the respondent is lacking records which were turned over to the petitioner, the petitioner shall provide same to the respondent. Insofar as the proffered objection does not provide any reason why the respondent should not render his account with reasonable expedition, for the period he served as fiduciary, the application is accordingly granted.

The respondent shall file his account, a petition for its judicial settlement and all of the papers required to obtain the issuance of a citation in the accounting proceeding within 60 days of the personal service upon him of a certified copy of the order to be entered herein. The respondent shall then, without delay, cause the citation to be served upon all parties required to be served in an accounting proceeding pursuant to SCPA 2210 and appear before the court from time to time as required for the purpose of the settlement of his account.
