ESTATE OF JOHN MATZINGER, ALSO KNOWN AS JOHN v. MATZINGER, Deceased (1166/A/10) — Prior to the return date of citation in this contested accounting proceeding, the court received a letter from a social services agency advising that a respondent, one of the decedent’s daughters, was under medical care and was not able to appear in court. On the return date, an attorney appeared on behalf of 10 respondents who were cited, including the daughter allegedly under a disability. Counsel for the parties thereafter entered into a written stipulation that was “so-ordered” by the court which, inter alia, directed counsel for the respondents to submit documentation concerning the nature of that daughter’s disability.

Counsel for the respondents submitted a letter dated June 28, 2013 from a staff psychiatrist at the social services agency stating that the subject daughter is diagnosed with chronic post traumatic stress disorder and Parkinson’s disease but, nonetheless, is competent to make reasonable decisions pertaining to her affairs. On this state of the record, including that the daughter is represented by counsel, the court will not appoint a guardian ad litem for her at this time; however, if appropriate, a guardian ad litem may be appointed for the daughter in any future proceeding.
