Plaintiff, Celeste Baptiste (“Baptiste”), brings this action under 42 U.S.C. §1981, and Title VII of the Civil Rights Act of 1964, as amended, §§2000e et seq. (“Title VII”), claiming employment discrimination on the basis of age, race, color, and gender, as well as unlawful retaliation for the exercise of protected rights, against her former employer, Cushman & Wakefield (“C&W”). The action was referred to this Court by the Honorable Richard C. Casey, United States District Judge, for general pretrial supervision. Presently before the Court is a dispute between the parties regarding Defendant’s request for the return by Plaintiff of an e-mail that came into her possession, which Defendant contends is protected by the attorney-client privilege. Plaintiff responds that the document is not privileged and, in any event, the privilege has been waived.
