A landlord who is being sued by a tenant whose children suffered neurological disorders from lead paint exposure failed to show that she didn’t have constructive notice about lead paint in the apartment, an appellate court ruled.

In January 2000, Nicole Brown began renting an apartment from Lula Mullen on the third floor of a four-story brownstone in the Crown Heights section of Brooklyn. While living in the apartment, Brown gave birth to Micah and Isaiah Greene.
