A federal judge has struck down California’s ban on the sale of foie gras after finding it was preempted by a federal law regulating poultry and poultry products.

The ban, which was approved by the Legislature in 2004 and took effect in 2012, prohibits both the forced feeding of birds—typically using a tube in a method called gavage—as well as the sale of foie gras, which is made from fattened duck and goose livers. Restaurateurs and farmers challenged the portion of the ban that prohibited foie gras sales.
