Kim, Kourtney and Khloe Kardashian lost their bid to compel arbitration with a makeup company that sued the reality TV stars for cosmetics trademark infringement. The sisters made a licensing agreement with Boldface Licensing + Branding Inc. to create a makeup line called “Khroma.” The distributor of an unrelated Kroma line of cosmetics, Kroma Makeup EU, was not pleased. Kroma Makeup EU ultimately sued Boldface and the Kardashians for trademark infringement, where the Kardashians’ motion to compel Kroma EU to arbitrate was denied. The U.S. Court of Appeals for the Eleventh Circuit agreed with that decision, and in doing so prompted Chief Judge Ed Carnes to contour his opinion with cosmetics puns. “At first blush, the issue appears to require application of Florida’s doctrine of equitable estoppel under which a party to an agreement who relies on it in a dispute with a nonparty can be required by that nonparty to comply with other terms of the agreement, including the arbitration clause,” he wrote. But “like makeup, Florida’s doctrine of equitable estoppel can only cover so much.” — Celia Ampel

CRACKER JACK

It’s been going on since October 2016. Once a month, according to The Niagara Gazette, a man comes to the same Tops Market in Niagara Falls, New York, to steal boxes of Cheez-Its. The first incident occurred on Oct. 19, when a man attempted to get past the cash registers with a shopping cart containing about $200 worth of the cheesy cracker. But when a manager approached him, he ran away and took off in a dark green Chevy Tahoe. Then, on Nov. 16, a man matching the original suspect’s description made off with 24 boxes of Cheez-Its, as well as 48 packages of peanuts. The haul was worth a little over $268. The last heist occurred on Dec. 1, when Tops employees spotted the same man escaping with 36 boxes of Cheez-Its and 72 cans of peanuts, valued at $402.12. Police described the suspect to The Buffalo News as about 6 feet tall, 200 pounds, and wearing a dark winter coat that may be black or black and blue. Although the police said nothing in their report about fingerprints, The Buffalo News surmised that the thief was likely to have suspiciously orange fingertips. — Richard Binder
