Already battling animal-rights and securities litigation involving its treatment of killer whales, SeaWorld Entertainment Inc., now faces a proposed class action alleging the company is breaching its contract with annual pass holders.

Pinellas County, Fla., plaintiff Jason Herman alleges that the water theme park makes it a practice to continue to charge a monthly fee following expiration of the year-long pass unless the customer cancels. Herman alleges that he met his end of the contract he signed on March 18, 2013, for two annual passes to SeaWorld in Orlando and Busch Gardens Tampa, by paying off the full cost of the passes in 11 months.
