A federal judge reduced a $9 billion jury verdict in the first federal trial over diabetes drug Actos by 99 percent, but what’s left still would rank among the largest punitive damages awards on record when compared to compensatory damages in the case.

U.S. District Judge Rebecca Doherty of the Western District of Louisiana on Monday dropped the jury’s award to $27.6 million against Takeda Pharmaceuticals USA Inc. and $9.2 million against Eli Lilly and Co., while rejecting a motion for a new trial on punitive damages. Both defendants had argued the original award violated their due-process rights under the Fourteenth Amendment. They have vowed to appeal even the reduced award.
