The U.S. Court of Appeals for the Ninth Circuit has declined to rule on a landmark challenge to delays by the U.S. Veterans Benefits Administration in providing mental health services and disability pay to thousands of veterans suffering from post-traumatic stress disorder.

In an en banc ruling on May 7, the Ninth Circuit said it lacked jurisdiction, rejecting a ruling by U.S. District Judge Samuel Conti in San Francisco that allowed two nonprofit organizations to seek declaratory and injunctive relief, but denying them any relief on the merits.
