Attempts by a village in the Florida Keys to preserve its character by banning some chain stores — including Starbucks and Walgreens — fell afoul of the U.S. Constitution on Sept. 8 the 11th U.S. Circuit Court of Appeals ruled. The court issued two concurrent opinions holding that the village's anti-"formula retail" and "formula restaurant" ordinance violated the dormant commerce clause and discriminated against interstate commerce.
