The U.S. Court of Appeals for the Fifth Circuit, for at least the third time, said Monday that a federal trial judge in Texas too readily penalized a lawyer or party in a case before him.

U.S. District Judge Mark Pittman abused his discretion in sanctioning a Texas lawyer for not complying exactly with an order in a former Weatherford College employee’s sexual harassment lawsuit against the school’s president, the Fifth Circuit said in an unpublished, five-page per curiam opinion.
