The U.S. Supreme Court on Monday zeroed in on when legal claims must be raised in order to be reviewable on appeal, a question that has divided lower courts and that some appellate attorneys are hoping for clarity on.

At issue is whether “purely legal claims” denied at summary judgment are eligible for appellate review if the argument hasn’t been reasserted in a post-trial motion. The U.S. Court of Appeals for the Fourth Circuit says no, while other federal appeals courts say yes, such as the D.C. Circuit.
