The U.S. Justice Department obtained court orders for phone and email records connected to an attorney for Steve Bannon as part of its criminal contempt case against the former Trump White House adviser, a move Bannon’s defense team denounced on Friday as “outrageous and inappropriate.”

Bannon’s lawyers asked the court to order the DOJ to reveal more information about how it obtained the records of Robert Costello, a partner at Davidoff Hutcher & Citron who represented Bannon in his dealings with the House select committee investigating the Jan. 6 attack on the U.S. Capitol. Bannon’s refusal to comply with a subpoena from that committee led to criminal contempt of Congress charges.
