The U.S. Court of Appeals for the D.C. Circuit has revived the House’s lawsuit challenging President Donald Trump’s diversion of military funds for border wall construction.

U.S. District Judge Trevor McFadden last year dismissed the case, finding the House lacked standing to sue over the executive order. A three-judge panel on the D.C. Circuit on Friday, pointing to the en banc circuit’s recent ruling on the House’s Article III standing to sue to enforce subpoenas, partly reversed McFadden’s ruling tossing constitutional claims made by the House and sent the case back to the trial court.
