Last term in Lane v. Franks, a unanimous high court held that the First Amendment protects a public employee from employer discipline for “truthful testimony under oath” when the testimony is not part of the employee’s ordinary job duties. The ruling was a major victory for government whistleblowers in general, and Lane in particular.
