As a quick reminder, the volume and quality of Litigator of the Week nominations were so high last week that we opted to hold over a whole column’s worth of runners-up for today. Runners-up honors also go to a trial team led by Jay Jurata of Dechert who fought off false advertising, deception and unfair business practices claims that start-up real estate brokerage startup REX-Real Estate Exchange Inc. brought against client Zillow. After a two-week trial, federal jurors in Seattle late last month sided with Zillow on the false advertising claim and on its affirmative defense to Rex’s Washington Consumer Protection Act claim. The team previously won a summary judgment ruling knocking out antitrust claims accusing the company of conspiring with the National Association of Realtors to prevent REX listings from showing up on the Zillow website. The trial team also included Dechert’s Russell Cohen, and associates Erica Fruiterman and Lauren Schnepper Junior, and Orrick, Herrington & Sutcliffe partners Laura Najemy and Aravind Swaminathan.
