A new federal class action alleges that a litigation support services firm hit with a cyberattack negligently exposed the health information of thousands of plaintiffs in mass tort litigation.

The lawsuit, filed on Tuesday in the Southern District of Texas, alleges Houston-based Marker Group failed to safeguard medical records and other sensitive information compromised in a Sept. 3 cyberattack. Filed by Morgan & Morgan attorney Phillip Sanov in Houston, the complaint is the first against Marker Group, which announced the cyberattack Dec. 23. The lawsuit was surfaced by Law.com Radar.
