One of the most controversial aspects of the current European Commission (EC) merger policy is the possible change in the standard for assessing mergers from the existing ‘dominance’ test to the US-supported ‘substantial lessening of competition (SLC)’ test.
The justifications for this change are explained in the green paper on Reform of the EC Merger Regulation, published in December 2001.
