Following the introduction in March 2000 of a new competition regime in the UK, it has remained unclear whether damages are available to those injured by anti-competitive conduct.
There is no specific provision in the Competition Act 1998 that gives the right to damages or imposes an obligation to make reparation on those in breach. European Community (EC) competition provisions (Articles 81 and 82), on which the UK prohibitions are modelled, are also silent on this question.
