Ashurst has represented a consortium led by Leighton Holdings Ltd. on its $3.2 billion winning bid to build a new rapid transit train network in Sydney. The consortium consists of two Leighton subsidiaries—Leighton Contractors Pty. Ltd. and John Holland Pty. Ltd.—Sydney-based engineering company UGL Rail Services, Hong Kong’s MTR Corp. and infrastructure investor Plenary Group. As part of the deal, Leighton Contractors, John Holland, UGL Rail Services and MTR will jointly design and construct a 36-kilometer rapid transit train system in Sydney, the first such fully automated system in Australia. The consortium will operate the system for 15 years, mainly by a separate joint venture between MTR, John Holland and UGL Rail. Plenary Group handled fundraising for the project. Ashurst Sydney partners Gareth Sage and Simon Irvine advised the consortium. Herbert Smith Freehills acted for the four design and construction contractors, while Corrs Chambers Westgarth Sydney partner Andrew Chew represented the joint venture operating the system once it’s completed.
