The U.S. Court of Appeals for the Third Circuit is expected to hear oral arguments Thursday on whether the Delaware Court of Chancery’s confidential arbitration program is a violation of the First Amendment’s qualified right of access and, therefore, unconstitutional.

A three-judge panel composed of Judges Dolores K. Sloviter, Julio M. Fuentes and Jane Richards Roth will listen to attorneys for both sides. Oral arguments were initially scheduled for May 9, but were rescheduled May 1.
