Delaware’s Judicial Nominating Commission has sent a list of three candidates to Governor Jack Markell for selection as the nominee to replace retiring Superior Court Judge Jerome O. Herlihy, according to sources in the legal community. The three nominees are said to be Richard A. Forsten, an attorney with Saul Ewing, New Castle County Court of Common Pleas Judge Andrea L. Rocanelli and Ferris Wharton of the New Castle County Public Defender’s Office.

The JNC sent the list to Markell on April 19 and the governor conducted interviews with all three nominees last week, according to sources within the state. Although sources did not know when the governor plans to submit his candidate to the General Assembly, it would likely occur in early May. The General Assembly ends its legislative session May 16, but does return in early June after a break.
