A complaint filed in the Court of Chancery by the creditor trustee in the bankruptcy of Insilco Technologies Inc. survived a motion to dismiss late last month, but only for those claims related to an allegedly unfair transaction.

The opinion from Vice Chancellor Leo E. Strine Jr. in Shandler v. DLJ Merchant Banking Inc., entered July 26, rejected a motion to dismiss fiduciary duty claims related to the sale of ThermaSys Corp., an automotive components business unit of Insilco, for $147 million.
