The 3rd U.S. Circuit Court of Appeals has held that Exide Technologies, which is in Chapter 11 bankruptcy, cannot reject a contract it entered with EnerSys Delaware Inc. that includes a license to use the Exide trademark.

Ruling in a case captioned In re Exide Technologies, the 3rd Circuit reversed a decision of the U.S. District Court for the District of Delaware, which had affirmed the bankruptcy court. The 3rd Circuit remanded the matter for proceedings consistent with its June 1 opinion.
