For SunTrust Bank, it was a clear defeat. But Kindred Nursing Centers will get a second chance to make its case in support of a patient arbitration agreement. The court remanded a dispute over whether a patient admitted to a Kindred rehabilitation hospital in Marietta had the capacity to consent to arbitration—an issue that made national headlines this week.
