The Georgia Court of Appeals is poised to decide whether someone can claim the right tog physical property over a trademark on Tuesday after litigators on behalf of a male sexual enhancement pill trademark holder and a gas station brought their case before Presiding Judge Stephen Dillard and Judges Brian Rickman and Trea Pipkin.

Will Brown, who held the product trademark, stopped selling the pills after the FDA voiced concerns over the product in 2014. However, two years later, the pills were on the gas station shelves again. Brown found out, showed up at the gas station, took the stock of allegedly counterfeit pills, assaulted one employee, yelled at others and possibly threatened them with a gun before leaving the store.
