Stites & Harbison and Wiley Rein filed a complaint for declaratory judgment on Wednesday in Georgia Northern District Court in connection with certain medical facilities alleged wrongful conduct with screening, marketing and selling donor semen. The complaint seeks a declaration that Allied World Surplus Lines Insurance Co. has no duty to defend or indemnify the defendants in underlying actions. According to the suit, the claims are not covered due to the defendant’s failure to report and make assertations under a miscellaneous medical facilities professional and general liability policy. Counsel have not yet appeared for the defendants. The case is 1:23-cv-03443, Allied World Surplus Lines Insurance Company v. Georgia Cryoservices, Inc. et al.
