Reversing a lower court’s decision, the Georgia Court of Appeals has granted summary judgment in favor of the Metropolitan Atlanta Rapid Transit Authority (MARTA) on negligence claims over a passenger’s fall on a train car.

In June 2017, Norman Brown boarded a train to return home and, just after he stepped onto the train, it pulled away, causing him to fall and hit his head. According to Brown, he was using a walker because he could not “stand that good” and dealt with gout in his leg, the court said in its Dec. 6 opinion.
