The Georgia Court of Appeals has vacated and remanded the dismissal of a medical-malpractice complaint filed against a urology center in Columbus due to the trial court failing to properly notify its clerk of a new filing date.

According to the appeals court’s Sept. 27 majority opinion, the case involves claims made by Linda Carol and Gary Goterba, who alleged that Dr. Nathan Pursifull and the Urology Center of Columbus performed surgery on Linda that resulted in lasting complications. A renewed complaint was dismissed in July 2021 because it was filed outside of the five-year statute of repose.
