The U.S. Court of Appeals for the Eleventh Circuit shot down the appeal of an attorney with the Atlanta Housing Authority after her suit against her employer was dismissed by a Northern District of Georgia judge for failure to state a claim under the National Defense Authorization Act.

Nevertheless, the appeals court did hold more broadly that the NDAA “clearly” provides whistleblower protection to employees of federal grantees.
