Following remand by the Georgia Supreme Court and Court of Appeals, a DeKalb County judge reversed a prior decision upholding a medical malpractice verdict and ordered a new trial for a woman left permanently disabled by a stroke after being discharged from a hospital.

The order entered Thursday by State Court Judge Johnny Panos said the 2017 verdict was void after the jury issued a post-apportionment award of over $600,000 for Janice Evans’ past medical expenses but nothing for future medical costs, pain and suffering or lost wages. Her husband’s loss of consortium award also was sliced almost in half, to $33,000.
