For nearly a decade, the Environmental Protection Agency has been working to develop construction stormwater runoff guidelines.

After being sued by environmental groups, the EPA issued Clean Water Act limitation guidelines for construction stormwater runoff that required compliance with numeric limits for turbidity. The rule codified as 40 C.F.R. Part 450 is known as the effluent limitations guidelines and new source performance standards for the construction and development, or C&D, point source category.
