Palm Beach Circuit Judge Robin Rosenberg is being reviewed for the federal court opening after U.S. Sen. Marco Rubio torpedoed the nomination of Miami-Dade Circuit Judge William Thomas.

The Southern District of Florida Blog run by Miami attorney David O. Markus reported the White House is vetting the judge who presides in criminal court.

She was one of three finalists with Thomas and Miami-Dade Circuit Judge John Thornton for the seat vacated in 2012 when U.S. District Judge Adalberto Jordan in Miami moved to the U.S. Circuit Court of Appeals for the Eleventh Circuit.

If nominated and approved by the U.S. Senate, Rosenberg would be assigned to hear cases at the new federal courthouse in Fort Pierce.

Rosenberg is the spouse of former Palm Beach State Attorney Michael McAuliffe.

Thomas was nominated to become the first openly gay black federal judge, but Rubio blocked a vote on him through a parliamentary procedure in the Senate Judiciary Committee.

When the Obama administration renominated dozens of lapsed judicial candidates this month, Thomas was the only name absent. Rubio has said he objected to Thomas because of his demeanor in a death penalty case and his sentencing of a man who killed a bicyclist in a high profile hit-and-run accident.

Rosenberg, a judge since 2007, previously served as a partner at Holland & Knight, general counsel at Slim Fast Corp. and an assistant West Palm Beach city attorney. She worked for the U.S. Senate Subcommittee on Juvenile Justice and U.S. Sen. Bill Bradley.

Rosenberg’s judicial assistant said the judge could not comment on whether she is being vetted for the federal nomination.
