A jury decided a home health care aide was not negligent in supervising an elderly man who fell and fractured a leg.

Jack Scharff, who died of prostate cancer at 91 a few months after the suit was filed, fell in the bedroom of his Palm Beach home and broke his right leg while under the supervision of a Comforts of Home aide. The estate claimed the aide left Scharff alone for an unreasonable amount of time. The estate claimed Scharff was prone to falling and should have been supervised at all times.
