A Miami Beach art broker is suing a prospective seller for allegedly backing out of a consignment agreement on a painting by famed early-20th-century Italian portrait artist Amedeo Modigliani.

The complaint filed Dec. 21 in Miami-Dade Circuit Court by Tableau Fine Art Group alleges Miami Beach resident Walter Rusniaczek claimed he couldn’t comply with the consignment deal after learning the broker lined up a $5.5 million sale because he had given the painting to his wife years earlier.
