The U.S. Court of Appeals for the Eleventh Circuit has ruled that an attorney’s motion for a protective order against the federal government in a tax evasion lawsuit was not barred by the Anti-Injunction Act.

The appeals court found that the statute cannot be applied to a defendant’s motions against a government-initiated suit. It vacated and remanded the lower court’s rejection of a taxpayer’s protective action.
