Barnes & Thornburg filed a trademark infringement lawsuit Tuesday in Florida Middle District Court on behalf of J.C. Newman Cigar Co. over its ‘The American’ mark. The suit takes aim at Levy Café for allegedly selling cigars which infringe the mark and are comprised of ‘legally identical’ ingredients. Counsel have not yet appeared for the defendant. The case is 8:22-cv-01313, J.C. Newman Cigar Company v. Levy Cafe, Inc.
