Florida-based railroad freight company CSX and other defendants were hit with a lawsuit Wednesday in Ohio Northern District Court arising from a May 2019 article posted on social media about a man who was fatally struck by a CSX freight train in Fostoria.

The lawsuit was filed by Wasserman, Bryan, Landry & Honold on behalf of Kirk E. Knopp, a former CSX conductor who was terminated over allegations that he violated the company’s social media policy, as his name was mentioned in the post. Knopp contends that he was denied an opportunity to engage in the board of adjustment hearing regarding the allegations, having been misinformed by his union that he need not attend. Counsel have not yet appeared for the defendants. The case is 3:22-cv-00553, Knopp v. National Railway Adjustment Board Special Board of Adjustment No. 1185 et al.
