A federal judge in Fort Lauderdale ruled that Nova Southeastern University must defend a class action lawsuit seeking multimillion-dollar damages, and that the school’s attempt to rely upon a newly enacted statute to retroactively shield itself from the matter was unconstitutional.

Attorney Seth Miles, a partner at Buckner + Miles in Coral Gables, is not involved in the class action lawsuit, but said U.S. District Judge Rodolfo A. Ruiz II, made the correct ruling in favor of the students, like Leo Ferretti, who attended Nova Southeastern during the 2019-2020 academic year.
