An appellate court in an insurance coverage case has reversed a trial court’s decision in favor of an insurance company, concluding that a 1985 decision by the Florida Supreme Court regarding the “failure to cooperate” defense set the standard for a jury instruction – and not a 2014 decision by the state’s top court.
