Just when it seemed like October couldn’t get worse for Yahoo Inc.’s legal department, a second ex-employee has emerged with claims that the performance review process ushered in by chief executive officer Marissa Mayer was used to illegally discriminate against men.

In a complaint filed on October 4 in U.S. District Court in San Jose, former senior editorial director Scott Ard alleges that a review process implemented in 2012, known as quarterly performance reviews (QPR), was manipulated by female higher-ups to undermine the careers of male employees. “Mayer encouraged and fostered the use of the QPR Program to accommodate management’s subjective biases and personal opinions, to the detriment of Yahoo’s male employees,” Ard’s complaint alleges.
