Summertime in corporate America means scaled-back dress codes and flex Fridays. But is the latter legal? Doug Hass of Franczek Radelet takes on the issue of whether compensatory time can be used for employees exempt from the Fair Labor Standards Act.

Employees, such as the white-collar executive, administrative or other professionals that are exempt from being paid overtime, actually may be compensated in some circumstances with time off. “Contrary to popular belief, the FLSA allows both public and private sector employers to offer comp time to their exempt employees, just under a different name,” says Hass. However, there is no obligation to provide them with this benefit.
