The California Department of Conservation, Division of Oil, Gas and Geothermal Resources recently released draft regulations regarding hydraulic fracturing, and officials are calling them “the toughest in the nation,” according to Todd Maiden, Marilyn Moberg and Michael Mandell on Reed Smith’s Environmental Law Resource blog.

The biggest issue so far seems to be the potential for trade secrets being released under the new requirements, which ask operators to publically post the trade name, supplier and descriptions of additives in the fracking fluids, according to the authors. They note similar legislation was introduced in Wyoming in 2010 and there has already been litigation over the exposure of trade secrets.
