On November 23, 2009, only a few days before expiration of a court-ordered deadline, the United States Environmental Protection Agency (EPA) released its final rules for water quality in runoff from construction sites.

EPA’s new rules—termed effluent limitation guidelines—follow on the heels of the new construction water quality permit issued by the California State Water Resources Control Board (State Water Board) in September 2009. The requirements of EPA’s new rules and the California permit differ, but also contain some common elements, and both will seriously impact construction projects in California.
